U.S. Senator Tommy Tuberville (R-AL) has introduced a Congressional Review Act (CRA) resolution of disapproval aimed at protecting Title IX and preserving women’s sports. The resolution, if passed, would overturn the Biden Department of Education's final rule that mandates schools to allow biological men who identify as female to use spaces designated for biological women and girls.
"This woke Title IX rewrite redefines gender and has the potential to impact women’s sports," stated Senator Tuberville during a press conference alongside Cindy Hyde-Smith (R-MS) and 32 Senate colleagues. He emphasized his commitment to fair opportunities in sports: "I spent my career dealing with athletes—men and women—and promoting fair opportunity to achieve in the classroom and the playing field."
Senator Hyde-Smith added her voice to the cause, joined by Senators John Barrasso (R-WY), Marsha Blackburn (R-TN), Mike Braun (R-IN), Katie Britt (R-AL), Ted Budd (R-NC), Bill Cassidy (R-LA), John Cornyn (R-TX), Tom Cotton (R-AR), Kevin Cramer (R-ND), Mike Crapo (R-ID), Ted Cruz (R-TX), Steve Daines (R-MT), Deb Fischer (R-NE), Lindsey Graham (R-SC), Chuck Grassley (R-IA), Josh Hawley (R-MO), John Hoeven (R-ND), Ron Johnson (R-WI), John Kennedy (R-LA), James Lankford (R-OK), Mike Lee (R-UT), Cynthia Lummis (R-WY), Roger Marshall (R-KS), Markwayne Mullin(R-OK). Pete Ricketts(R-NE). Jim Risch(R-ID). Mike Rounds(R-SD). Marco Rubio(R-FL). Eric Schmitt(R-MO). Tim Scott(R-SC). Thom Tillis(R-NC). J.D. Vance(R-OH) . Roger Wicker(R-MS).
The Independent Women’s Forum and Parents Defending Education Action have expressed support for the CRA.
As a former educator, mentor, and coach for over 40 years, Senator Tuberville is particularly concerned about the future of girls’ and women’s sports. Having started his career coaching high school girls' basketball shortly after Title IX was enacted, he has witnessed its positive impacts firsthand.
In June 2022, on Title IX's 50th anniversary, the Education Department proposed allowing biological males to compete in women's sports—a move met with significant opposition. Despite nearly 240,000 comments against it, the department finalized the rule in April 2024. This regulation extends protections under Sexual Orientation and Gender Identity into Title IX, potentially allowing biological males identifying as females to participate in women's sports.
Senator Tuberville has consistently opposed these changes, issuing statements condemning them and pledging continued resistance.
