Tuberville joins GOP colleagues urging Supreme Court support for parental notification rights

U.S. Senator Tommy Tuberville, alongside U.S. Senator Bill Cassidy and U.S. Representative Robert B. Aderholt, has joined 63 Republican colleagues in submitting an amicus brief to the U.S. Supreme Court in the case of Mahmoud v. Taylor. The brief advocates for parents' constitutional rights to be informed about and have the option to exclude their children from school teachings on gender ideology that conflict with their religious beliefs.

Senator Tuberville emphasized, "Our kids go to school to be educated, not indoctrinated," expressing concern over educators allegedly pushing personal ideologies onto students. He further stated, "We need to create greater transparency in our education system to empower parents and protect our kids." Tuberville expressed pride in collaborating with Senator Cassidy and Congressman Aderholt on this matter.

The case stems from a decision by the Montgomery County School Board in Maryland which introduced new books focusing on gender identity and sexuality into classrooms from pre-K through eighth grade. Initially, parents were assured they would receive notifications about these readings and could opt their children out if desired. However, this policy was revoked in March 2023.

The submitted amicus brief contends that this policy infringes upon parents' rights under the First Amendment regarding religious upbringing decisions for their children concerning topics like gender and sexuality. It argues against the necessity of such a policy under federal antidiscrimination law and questions its justification given existing federal statutes supporting parental rights in education.

Other senators who supported the amicus brief include Pete Ricketts, Roger Wicker, Jim Justice, Ashley Moody, Tim Scott, Josh Hawley, Steve Daines, Markwayne Mullin, James Lankford, Chuck Grassley, Ted Budd, Mike Lee, Ted Cruz, Marsha Blackburn, Tim Sheehy, and Jim Banks.

Senator Tuberville serves Alabama as part of several Senate committees including Armed Services; Agriculture; Veterans’ Affairs; Health Education Labor Pensions (HELP); and Aging Committees.
