In January 2025, U.S. Senator Tommy Tuberville (R-AL) reintroduced the Protection of Women and Girls in Sports Act, also known as S.9, aimed at safeguarding women's sports and preserving Title IX protections for female athletes. This legislation responds to actions by the Biden administration that critics claim have undermined Title IX, with over 900 women reportedly losing trophies to men competing in women's sports. Public opinion appears to be against these policies, with 79% of Americans opposing men competing against women.
Senator Tuberville has been a vocal advocate for protecting women's sports throughout his tenure in Congress. He previously pushed for an amendment to prevent men from participating in women's sports; however, it was voted down by all 51 Democrats. Earlier this February, President Trump signed an Executive Order banning men from competing in women's sports and protecting Title IX, but such orders can be reversed. Tuberville's bill seeks to make Trump's Executive Order permanent.
The U.S. House of Representatives passed similar bipartisan legislation in January. Senate Majority Leader John Thune (R-SD) announced that S.9 would receive a vote on Monday, March 3. In anticipation of this vote, support is being voiced by a coalition of former and current female athletes, coaches, parents, lawmakers, and advocates.
Senator Cindy Hyde-Smith (R-MS) expressed her support: "Congress established Title IX to ensure that women and girls have equal and fair opportunities based on biological reality." Similarly supportive sentiments were echoed by other senators including Cynthia Lummis (R-WY), Jim Risch (R-ID), Greg Steube (R-FL-17), Mary Miller (R-IL-15), as well as several athletes and coaches who shared their experiences.
Jennifer Sey emphasized the issue's non-partisan nature: "It’s about basic biological truth and fairness for women and girls." Kaitlynn Wheeler added her perspective: "This vote is a chance for leaders on both sides of the aisle to do what’s right."
Many voices stress the importance of fairness and safety within women's sports as central tenets needing protection through legislative action.
