Today, U.S. Senator Tommy Tuberville (R-AL) shared his perspective in the Washington Examiner on his proposed legislation, the Repealing Big Brother Overreach Act, also known as S. 100. The bill aims to repeal the Corporate Transparency Act (CTA), which Tuberville argues imposes excessive burdens on small business owners through stringent reporting requirements.
"The CTA requires people with 'substantial control' over a company, an equity position of 25% or greater, to disclose personal data to the Treasury Department’s Financial Crimes Enforcement Network," Tuberville explained. He noted that noncompliance could result in significant fines and imprisonment, which he believes is detrimental to small businesses already struggling under current economic conditions.
Tuberville criticized the Biden Administration's economic policies over the past four years, claiming they have been harmful to small businesses. "America’s small business owners have been forced to storm a rocky economy under an administration that has been hostile to them for four years," he stated.
The senator expressed concern about the potential penalties associated with the CTA: "As if these new requirements aren’t daunting enough for small business owners, those who fail to comply with the law can face up to $10,000 in fines and up to two years in prison."
An injunction currently prevents the CTA from taking effect, but its future remains uncertain. In response, Tuberville has reintroduced his bill to eliminate what he sees as governmental overreach. "This is a much-needed piece of legislation that will help small businesses succeed, not suffocate," he asserted.
Tuberville's effort is supported by Rep. Warren Davidson (R-OH), who is introducing a similar bill in the House of Representatives. Tuberville emphasized the importance of supporting small businesses as vital components of America's economic foundation: "Small businesses are the bedrock of the American dream."
He urged his Senate colleagues to back his proposal: "I am calling on my Senate colleagues to support my legislation so we can get the federal government off the backs of business owners and let them flourish."
