U.S. Senator Tommy Tuberville (R-AL) and Senator Bill Hagerty (R-TN) have introduced the Equal Representation Act, a legislation aimed at excluding illegal immigrants from being factored into the count for Congressional districts and the Electoral College map that determines presidential elections. The current method of counting illegal immigrants for representation purposes is seen as a way to boost the political power of states and voters that support open borders.

Senator Tuberville expressed his support for the legislation, stating, "Illegal aliens have no right to congressional representation in this country. They shouldn't even be here. Yet right now, tens of millions of illegal aliens are here and affecting the balance of power in Congress. This is a slap in the face to EVERY American citizen, whether Republican, Democrat, or Independent. I support the Equal Representation Act so that all AMERICANS get fair and equal representation in Congress."

The bill has garnered support from several cosponsors, including Senators Marsha Blackburn (R-TN), Mike Braun (R-IN), Katie Britt (R-AL), and Ted Budd (R-NC), among others.

The current method of counting illegal immigrants for congressional district apportionment and Electoral College votes has been a contentious issue. For example, in a state like California, the presence of millions of illegal alien residents results in the state having several more congressional seats and Electoral College votes than its population of citizens would justify. This creates a perverse incentive that encourages illegal immigration and resettlement to increase political power.

The Equal Representation Act aims to address this issue and ensure that the power of a citizen's vote is not diluted by the presence of illegal immigrants. It comes in response to a video revealing a Democrat Congresswoman openly calling for more illegal immigration to her New York congressional district for redistricting purposes.

Senator Tuberville has been a vocal advocate for securing the border and implementing common-sense policies to strengthen national security. He has supported initiatives such as building the wall and reinstating the Migrant Protection Protocols, also known as the Remain in Mexico policy.

In December 2023, Coach and House Veterans Affairs Committee Chairman Mike Bost (R-IL) introduced legislation to stop the use of Department of Veterans Affairs (VA) resources to provide taxpayer-funded healthcare to illegal aliens. Coach Tuberville has also introduced the Border Safety and Security Act to address the border crisis created by President Biden's immigration policies.

The introduction of the Equal Representation Act is another step towards ensuring that every American citizen, regardless of political affiliation, receives fair and equal representation in Congress. By excluding illegal immigrants from the count for congressional districts and Electoral College votes, the legislation aims to prevent the manipulation of political power and uphold the integrity of the democratic process.
